- In this article we address the constructionof familiarity and distance in Swedish district courtcases, involving young men with both immigrantand Swedish backgrounds. Through ethnographicobservations of 40 trials related to street crimes, wehave found different qualities of social interaction that distinguish immigrant background and Swed-ish background cases from each other. These distinc-tions, disfavouring young men with immigrant back-ground, are built up through a series of practices and events that follow taken-for-granted behaviourand details in interaction, such as speech, laughter,choice of words to describe the accused and trust inSwedish witnesses. In conclusion, we argue for thenecessity of detailed, close-up studies of courtroom action and interaction to understand statistical find-ings of discrimination and disfavouring of certain groups of immigrants in court and elsewhere in thejudicial process.

- This paper addresses the risk of research exposing people with an immigrant background in criminal court cases to Internet-based racist persecution, due to mismanagement of general ethical guidelines. The principle of informed consent, ideally serving to protect people under study from harm may, in fact, cause them more harm due to the interest among certain Internet-based networks of spreading identifiable, degrading information. Arguments are based on ethically challenging experiences from two ethnographic research projects carried out in Swedish district court environments, focused on immigrant court cases. Ethical advice provided by ethical review boards and established research guidelines, were based on an unawareness of the potentially destructive rendezvous in media attractive immigrant court cases between ‘ethically informed’ research, crime journalism, freedom of information legislation and ‘Internet vigilantes’ on a quest to persecute court participants and their families in the global digital arena.

- This paper deals with methodological challenges presented while carrying out observations during an ethnographically inspired research project into notions and ideas about culture, ethnicity, gender and age within a Swedish courtroom context. Approximately 20 court cases on “street related crime” and “domestic violence” have been studied by means of observations in court, interviews with defendants and readings of court documents. Two analytical courses of action have emerged while applying postcolonial perspectives on preliminary findings; one being to address the court as an arena for multiple, concurring and conflicting voices and the other as a discursive arena for epistemological colonialism, or as contemporary, inherited expression of a Nordic (discursive) colonialism. However, the intersectional approach of trying to account for several concurrent voices proposes some interesting methodological challenges, which is the focus of this paper. One such challenge is related to scope and range of social categories present in the court context, placing great demands on the researcher’s ability to “keep track” of multiple perspectives/voices simultaneously. The paper will address this issue by exploring questions concerned with the amount of time and material needed to reach empirical saturation, as well as potential methods facilitating the acknowledgement and observation of a multi-perspective presence. Another challenge when doing research in a setting characterized by diversity related to the (un)awareness of the researcher’s situated knowledge and position(s) within specific discursive homes. The paper will discuss methodological possibilities as well as difficulties when it comes to accounting for the agency of people found to be othered in courtroom discourse and interaction. The importance of interviews to verify or contest researcher findings will be addressed, in addition to the importance of empathy and dangers of “othering” when approaching a diverse setting.

- This article argues that court-ritual unawareness, linguistic shortcomings andstereotypical images about non-Swedish otherness impair the position and actingspace for immigrants in a Swedish district court context. Drawing on two ethnographicallyinformed research projects focused on courtroom interaction during morethan 20 trials dealing with ‘domestic violence’ and ‘street-related crime’, we claimthat immigrant voices are often silenced due to taken-for-granted practices in court.Through analyses of interviews, performances, interpreted hearings and references toa desirable Swedishness, it is argued that situations are created where immigrantparticipants may experience their possibility of being understood as limited and theirvoices as being unheard. Such conditions are emotionally draining and may result inparticipants choosing silence over stating their case. This is a problem, not only withinthe individual court case, but also for the overall legitimacy of the court system and forissues of institutional trust among citizens.
