- Combatting marriages by a child has been been on the Swedish legislative agende since the early 2000s. Law amendments have been carried out in 2004, 2014 and 2019, each reform adding new restrictions. This article takes a critical approach to these reforms, with focus on the unpredictability of the outcome, and on the consequences of legally limping family relations, failing the protective needs of the vulnerable.

- This contribution evaluates the Nordic (primarly Swedish and Finnish) impact on the Europen Union's civil law cooperation within family law and the law of inheritance, starting from mid 1990s when Sweden and Sweden joined the European Union. Both countries have strived to have progressive, pragmatic EU-regulations, and have succeeded to some extent. In addition, they have strived to maintain a certain level of legal coherence in relation to special conventions previously adopted between the five Nordic states (Denmark, Finland, Iceland, Norway and Sweden). As a result, in the manner explained in the contribution, amendments of the Nordic Conventions reflect those of the new EU regulations. All of the hitherto adopted EU-regulations include special provisions in relation to the Nordic Conventions (so-called "Nordic exceptions").

What the family (or a parent) considers to be inte child's best interests and welfare in the studied situations is not shared by society at large. The various contributions, written primarily by leading experts and with an interdisciplinary element, address situations of conflict regarding the child's upbringing and education, the shaping of the child's cultural or faith-based identity, underage marriage, circumcision of boys, forced placements of children into care outside of their parental home, and the role of faith in cross-border custody disputes.

Cross-Border Recognition of Formalized Same-Sex Relationships in Europe : The Role of Ordre Public in the Baltic States and Poland

- Same-sex relationships have successively qualified for formalization through marriage or registered partnership in many European countries, although some countries in Europe still refuse to give them any form of recognition or only allow very limited effects. The irregular speed of development in domestic family laws in European States results in “limping family” relations, that is, family relations that are recognized as creating a formal family civil status in many European States but not in all of them. The ordre public safeguard of private international law has widely been used to justify why a same-sex marriage or a registered partnership cannot be recognized. National identity is, allegedly, threatened. Nevertheless, case-law of the European Court of Human Rights and the Court of Justice of European Union provides new standards for recognition, which obliges these States. This thesis focuses on the interaction of human rights standards and private international law; investigating the impact of Europeanization on it, and analysing cross-border legal effects of same-sex marriages and registered partnerships in the Baltic States and Poland. The task involves evaluating the impact of culture in this area of study, as created within the context of each State’s recent history, societal developments, and religion. The thesis analyses ideological clashes concerning the inviolability of human dignity and non-discrimination, on the one hand, and a preference for national “traditional” family values, on the other hand.
