    • The Swedish prostitution law from 1999, now followed by Norway and Iceland, criminalized the purchaser and decriminalized the prostituted person. This is analyzed as a cogent state response under international trafficking law, particularly to the obligations set forth in the United Nation’s Trafficking Protocol from 2000. The Protocol states that a person is regarded a trafficking victim when, e.g., someone abuses her “position of vulnerability” in order to exploit her. International jurisprudence and social evidence strongly suggest that prostitution, as practiced in the world, usually satisfies this definition. Further, the Protocol urges states to reduce the demand for prostitution and to protect and assist victims, for instance by adopting laws deterring purchasers of sex, and by supporting those exploited in prostitution. Policy makers, such as the U.S. Department of State, are criticized for taking an inadequate position in face of the growing evidence from the Swedish law's impact.The article shows that Sweden has significantly reduced the occurrence of trafficking in Sweden compared to neighboring countries. It also scrutinizes some misinformation of the law's impact, showing for instance that claims alleging a more dangerous situation for those still in prostitution after 1999 were unfounded. In addition, the article addresses remaining obstacles to the law's effective implementation, arguing that in order to realize the law's full potential to support escape from trafficking, the civil rights of prostituted persons under current law should be strengthened to enable them to claim damages directly from the purchasers for the harm to which they have contributed, and for the violation of the prostituted persons' equality and dignity - a position now recognized by the government to some extent by clarifying amendments made in 2011.

    • A shift from politics to law, inefficient enforcement tools, and dislodgment from action to information as well as criticism of gender equality from various angles have all had an impact on the law’s ability to contribute to the achievement of gender equality in Sweden. It is not primarily through anti-discrimination legislation and litigation that gender equality has been achieved in Sweden, and such an approach will probably not be the main strategy in the future. Still, we have to continue to improve the protection provided to victims of individual discrimination and harassment. The Swedish case shows how the individual’s right to access to justice can be undermined in a context where state bodies – such as the Ombudsman – are given wide discretionary powers to promote equality as a collective public interest.

    • This book provides insights into the drive to achieve substantive gender equality in four Nordic countries: Finland, Iceland, Norway and Sweden. It draws a diverse and complex picture of the long, uneven, and unfinished process towards that goal. These countries’ systematic use of a combination of political and legal instruments has been described as the Nordic gender equality model. The overall aim of such an approach is to achieve substantive equality through a variety of measures that go beyond formal equality. Laws and policies on gender equality vary with the political, social and legal context in each of the Nordic countries, but the Nordic gender equality model may be understood as consisting of three key components. The first is an overarching gender equality policy. The second is welfare legislation that has an explicit or implicit impact on gender relations. The third component is what we refer to as ‘gender equality and anti-discrimination law regimes’: laws that prohibit gender discrimination and promote gender equality through proactive measures, in combination with low-threshold enforcement systems.

    • The notion of the best interest of children figures prominently in family and reproductive policy discussions and there is a considerable body of empirical research attempting to connect the interests of children to how families and society interact. Most of this research regards the effects of societal responses to perceived problems in families, thus underlying policy on interventions such as adoption, foster care and temporary assumption of custodianship, but also support structures that help families cope with various challenges. However, reference to the best interest of children can also be applied to a more basic issue in family policy, namely that of what is to be considered a family in the first place. This issue does not raise any questions regarding the proper conditions for when society should intervene in or change the family context of a child. Rather, it is about what social configurations should be recognized as a potentially fitting context for children to enter into and (if all goes well) eventually develop into adulthood within /.../ such that society’s default institutional arrangements allow it to have (by sexual and artificial reproduction, adoption, and combinations of these), care for and/or guard children. [This] will frame any further discussion of /.../ policies having further implications for, for example, the practices of adoption and reproductive technology, as well as regulation of custody in the event of separation or parental disagreement.

  • Regulation of ships at anchor: Safety and environmental implications

    • Ships waiting at anchor are associated with considerable environmental pressures and impacts. Growing and congested anchoring areas are receiving increasing scholarly attention to understand the environmental effects caused by large sea-going ships anchoring in coastal waters. While there is a lack of studies addressing the entire spectrum of environmental pressures and impacts from ships at anchor, ranging from scouring of the seafloor, operational emissions and discharges and waste from maintenance carried out while at anchor, it is well established that anchoring is associated with such pressures. This article takes a problem-oriented approach since there are potential cumulative environmental impacts of ships waiting at anchor. From both a public and private law perspective, we examine the legal structures and challenges associated with the regulation of ships waiting at anchor. We also analyze the public and private law factors that may limit the ability to prevent harmful anchoring practices. Our examination shows that while coastal states have significant jurisdictional powers to regulate anchoring in coastal waters, the current international regulatory framework addresses anchoring incidentally and lacks mechanisms for considering the cumulative impacts of anchoring. Furthermore, the incentives for ships to spend a considerable amount of time at anchor appear to differ substantially across different types of charterparties. Improved regulation requires better scientific knowledge, substantial mapping of legal structures, and a stakeholder survey providing a basis for the exploration of potential contractual practices that may reduce market incentives for anchoring.

    • The regulation on ship recycling at international and European Union (EU) level has transitioned from the realm of transboundary movement of wastes to a specialized regime, i.e., the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships (2009) (Hong Kong Convention). Although this convention is not in force yet, the principal features of it have been incorporated in EU Regulation 1257/2013 on ship recycling. This paper examines the rationale behind developing a ship recycling regime, its disassociation from wastes, and the departure from the main principles of transboundary movement of wastes, such as the proximity principle, reduction of transboundary movement of wastes, and the prior informed consent procedure. While acknowledging some of the positive features of the emerging ship recycling, it is submitted that the Hong Kong Convention and EU Regulation 1257/2013 on ship recycling represent a step back in the regulation of ship recycling.

    • The Maastricht Treaty (the “Treaty”) first introduced the status of EU citizenship. The twentieth anniversary of the signing of the Treaty, marked in 2013, was declared the European Year of the Citizen. Union citizenship has been understood as the world’s first post-national citizenship, although it is still complementary to national citizenships. EU citizens enjoy rights that have been expanded, modified, and reinterpreted in light of the EU integration process. The Court of Justice of the European Union (CJEU) has been a driving force in this process. This twentieth anniversary has provided the occasio for this special issue. Indeed, much has happened over the last two decades. The Maastricht Treaty entered into force on the heels of German reunification, and afterwards, a series of EU treaties followed: The Amsterdam Treaty, the Nice Charter of Fundamental Rights, the aborted constitutionalization process and the Rome Treaty in 2004, and the Treaty of Lisbon. The Euro took over former national currencies in 2002; the enlargement process led to today’s twenty-eight Member States. But the ratio of this special issue is based on other events as linked to the 2008 financial crisis, bailouts, the fiscal compact, and similar measures. In a nutshell, the timeliness of this volume is linked to the current financial disarray. Since prognosis presupposes diagnosis, no further words are necessary as to the importance of this task. It is (almost) self-evident that before taking action and preparing for the future, one needs to address the very first question: Nosce te ipsum...

    • The ocean provides essential ecosystem services such as food production, off- shore renewable energy, carbon sequestration, and recreation. However, scientif- ic evidence warns us about the severe impacts the ocean is facing due to pollution, unsustainable fishing practices, and climate change effects. These effects include ocean acidification, biodiversity loss, and sea level rise. From international, EU, and national perspectives, there is an outspoken aim to boost the ‘blue’ economy while securing healthy marine ecosystems. However, the legal system handling these integrated demands is diverse and fragmented regarding sectoral aims, geographical areas, and governance levels. In their current form, they are not designed or fit to provide an ecosystem-based approach to managing human–ocean relations or to implementing the objective of a healthy and sustainable ocean. To integrate legal competence relevant to ocean governance in both practice and theory, scholars of different legal areas within the Department of Law col- laborate internally and, more importantly, with scholars within other disciplines and actors outside academia. Our ambition is for this interdisciplinary endeavor to prompt changes in socio-environmental governance structures and legal ed- ucation. From a socio-environmental perspective, we examine opportunities to integrate our knowledge of different legal areas and improve our transdisciplinary capacity. We analyze and discuss challenges, drivers, and pathways to provide knowledge supporting a transformation to a more sustainable blue economy. From a legal education perspective, interdisciplinarity requires a problem-based approach and the introduction of threshold concepts that shape how we apprehend a particular phenomenon. Ocean governance is an example of a concept providing a valuable opportunity for broader legal reasoning and for finding meaning- ful connections between national, regional, and international law.

    • Inom ett pågående forskningsprojekt tillämpas teorin om stigbundenhet (eng. path dependency) på LVU-processen i syfte att problematisera varför upphörande av tvångsvård av barn möter vissa svårigheter. Teorin om stigbundenhet innebär, som förklaringsmodell för mänskligt och institutionellt beteende, att beslutsfattande tenderar att följa en redan inslagen väg, det vill säga tidiga vägval får betydelse. Allteftersom samma stig återkommande beträds av olika aktörer blir den allt mer inarbetad. Sannolikheten ökar för att samma väg beträds av nästa aktör, vilket så småningom resulterar i självförstärkande cykler. Artikeln beskriver tre sammanhang där stigbundenhetstesen metodologiskt operationaliseras till en (process)rättslig, en institutionell respektive en normativ kontext. Våra empiriska resultat (kvantitativa och kvalitativa) illustrerar i dessa sammanhang stigbundenhetsproblematiken och uppkomsten av vissa vägvalssituationer, så kallade critical junctions. I artikeln redogörs självreflektivt för metodens hermeneutiska återkoppling till de teoretiska ingångsvärdena. Studien påvisar teoribildningens relevans för studiet av relevant rättsområde, dess reella rättstillämpning och även bakomliggande lagstiftningsprocess. I Sverige innebär den senaste tidens snabba lagstiftningsåtgärder att stigbundenheter riskerar att befästas som lagbundenheter.

    • The present article series deals with one of the most difficult dilemmas pertaining to child protective custody: balancing long-term stability for children in care against family reunification as ultimate goal. In the first part of this article series, the balance was traced through the formal requirements applicable to, on the one hand, the initiation of child custody and on the other hand, its termination. The first article concluded that – at least with respect to foster home assignments – the longer children stay in protective care, the more difficult it becomes for families to reunite. Path dependency – a theoretical model from the social sciences – was suggested towards, if not explaining, then at least understanding some elements of the legal proceedings conducive towards lock-in effects. These conducive mechanisms are here, in the second article of this series, placed in three legal contexts: First, the procedural framework representing the base rules. It is argued that administrative courts’ ex officio mandate, the loose ambit of “therapeutic” proceedings in combination with the allocation of the burden of proof slant the playing field against individual litigants (albeit in order to “help” them). The playing field itself – referred to as a second institutional context, is then approached from the vantage point of legal theory, taking account of Swedish and international empirical data on different litigants’ litigation odds. In a third, normative context, prevailing notions of familial normality and deviation are explored in order to trace additional factors making it difficult to break the cycle of protective measures.

Det innebär att den svenska juridiken på ett förmodligen aldrig tidigare skådat sätt har tagit strid med politiken om en lag. Det är en sensation, med potentiellt stora konstitutionella implikationer.

Modern states’ authority claims and their exercise of power and sovereignty span a spectrum: from the most stringently and explicitly codified—the constitutional level—to the most fluid and turbulent acts of war. The Public Uses of Coercion and Force investigates both these individual extremes and also their relationship. Using Arthur Ripstein’s recent work Kant and the Law of War as a focal point, this book explores this connection through the lens of the (just) war theory and its relationship to the law. The Public Uses of Coercion and Force asks many key questions: what, if any, are the normatively salient differences between states’ internal coercion and the external use of force?     • Hur hanterar föräldrabalken att män föder barn och att kvinnor kan ha spermier? År 2013 avskaffades krav på sterilisering i samband med ändring av juridisk könstillhörighet och år 2019 infördes ett nytt avsnitt i föräldrabalken om transpersoners och intersexpersoners föräldraskap. Ytterligare bestämmelser införs i januari 2022. Denna artikel syftar till att beskriva och kritiskt analysera den rättsliga regleringen för föräldraskap vid ändrad könstillhörighet. Artikeln beskriver hur regleringen växt fram och förklarar hur den tillämpas i olika situationer. Reglerna har blivit anmärkningsvärt komplicerade, framför allt för att lagstiftaren har behållit de traditionella reglerna för faderskap och moderskap oförändrade och i stället lagt till ett separat avsnitt med tilläggsbestämmelser. Detta medför ett flertal praktiska och stigmatiserande problem. En utredning har tillsatts för att överväga hur föräldrabalken kan göras mer könsneutral för att undvika sådana problem. Avslutningsvis diskuteras därför möjliga utformningar av en sådan lagstiftning.

    • In this article, Value Added Tax (VAT) is examined as a legal transplant. The legal transplants theory relies on the assumption that legal transplants are the primary driver behind legal change. In order to establish whether this is the case for VAT, the distribution of VAT across the world is examined. This spread, however, should be evaluated against the different legal VAT families that may be identified around the world in order to determine if the identity of the transplanted system remains. That said, VAT families vary over time, and there is no specified definition of different VAT families. The establishment of the relevance of studying VAT as a legal transplant may feasibly lead to a discussion on whether a legal transplant approach is appropriate for comparative research in VAT since such an approach entails a risk for too much emphasis on similarities. The fact that statutes appear to be similar does not necessarily mean that the law is the same due to various factors such as legal culture. However, with an awareness of the inadequacies of the legal transplants approach as a method for comparative studies, the approach may provide valuable insight into explaining the similarities and differences in VAT.

    • The general assumption in the West is that there still is an inherent difference between persons and things. This divide informs how “the human” and human subjectivity are constructed as distinct from all others. Recently, the distinction has been challenged in posthumanist theory, where it has been argued that the divide between human and nonhuman agents—or rather, bodies—is always an effect of a differential set of powers. For this reason, the boundaries between human and nonhuman are always in flux. As posthumanist theorists have argued, this change in boundaries may be specifically visualized in relation to digital technology. Today, such technologies obfuscate the boundaries between persons and things, and the extensive utilization of smartphones, social media, and online search engines are just three common examples. In parallel to the continuous expansion of digital technologies, critical understandings of how “data” and human personhood are produced are increasingly raised in legal theory. Recent developments establishing increased privacy online through EU law, including the new General Data Protection Regulation and the famous Right to Be Forgotten case could possibly be understood to have struck a balance between interests of the human–in the form of privacy—and the digital—in the form of information diffusion. In this Article, a posthumanist theoretical perspective is utilized to show how the new data protection legislation, with a focus on the Right to Be Forgotten, produces such protection yet continuously withdraws data as a separate body from human bodies. For this reason, it is argued that the construction of new human rights, such as those considering data protection, would benefit from understanding how the separation is, in itself, an effect of advanced capitalism.

    • The Nord Stream project, which comprises two natural gas pipelines in the Baltic Sea, eminently illustrates several of the ambiguities that pertain to the ability of coastal States to regulate the laying and operation of transit pipelines in their exclusive economic zone and, conversely, the extent of the right of other States to carry out such activities. A highly significant issue is how seabed surveys undertaken in preparation for the laying of pipelines should be characterized, and thus regulated, under the United Nations Convention on the Law of the Sea. What is to be considered a ‘reasonable measure’ by a coastal State is another crucial issue which, together with the extent of the requirement for consent by the coastal State for any specific pipeline route, are decisive for defining the balance between potentially competing interests relating to submarine transit pipelines.

    • Who is a mother? In recent decades, a broader array of family and parenthood scenarios has been legally recognized in Sweden, as well as in several other jurisdictions. However, at least in Sweden, the rules of maternity continue to be rooted in ancient Roman principles, presuming that a child's mother is the woman who gives birth. This principle has been challenged by adoption, uncertain maternity, egg donation, surrogacy, same-sex couples, and transgender parents. Yet, these situations are governed by exception rules, which are often more complicated and less favourable for the child. My PhD thesis explores the evolution of legal parenthood from a norm-critical perspective. This involves critically examining and highlighting what is perceived as standard or neutral, what are considered special cases or exceptions to such norms, and what is viewed as non-existent. Maternity is intimately tied to perceptions of womanhood. This paper seeks to explore how patterns of norms and exceptions in legal parenthood can be understood when approached from different angles, such as essentialism, social constructivism, performative acts, and material conditions.

  • Nordic Equality and Anti-Discrimination Laws in the Throes of Change Legal developments in Sweden, Finland, Norway, and Iceland

    • The Nordic states were among the first in the world to enact general gender equality and anti-discrimination laws with low threshold enforcement mechanisms. Today, the Nordic countries top the World Economic Forum’s Gender Gap Index – but have still not succeeded in closing the gender gap. This book draws a diverse and complex picture of the long, uneven and unfinished process towards substantive equality in four Nordic countries: Sweden, Finland, Norway and Iceland. It presents the Nordic gender equality model’s systematic use of three measures: overarching gender policies, legislation that has an explicit or implicit impact on gender relations and gender equality and anti-discrimination laws with low threshold enforcement systems. What potentials and limitations does the Nordic gender equality and anti-discrimination law regimes have to combat individual discrimination and structural inequality? Can these regimes function as a driver of political, legal, economic, cultural and social change, and as a corrective to laws, policies and practices that uphold existing inequalities, and, if so, to what extent? Can weaknesses in the equality and anti-discrimination laws and the way they are enforced hamper efforts to close remaining gender gaps? Rather than looking at the Nordic gender equality laws and policies in isolation, the book situates their development and transformative potential within a changing European and international political and legal landscape.

    • Supplementary Protection Certificates (SPCs) were introduced in 1992, and have since been considered a very valuable tool for the pharmaceutical industry, allowing for market prolongation and compensating for the effective patent protection time lost in the process of market authorization.Over the past five years, numerous Court of Justice of the European Union (CJEU) rulings have attempted to interpret the provisions of EU Regulation 1901/2009 and provide clarity to patent holders as well as generics manufacturers as to the protection requirements and the scope of protection awarded. This article analyses the implication of major CJEU cases concerning the interpretation of Articles 3(a), 3(d) and 1(b) of the Regulation.The article also discusses the interrelation between the EU SPC Regulation, on the one hand, and the Market Authorization Regulation and the Market Authorization Directive, on the other, and compares the EU system with that provided by the USA. An analysis of recent case law reveals that now, some 25 years after the entry into force of the Regulation, the system is still obscure. A serious concern also arises as to whether the system as it stands today is simply inappropriate to the protection of modern pharmaceuticals and whether this is also one of the reasons for the growing volume of case law in the field.

    • Legal tech is growing, and its growth provokes anxieties about the future of the legal profession as such. In this article, we examine the impact of legal tech on the central role of lawyers at law firms in crafting an imagined ‘right legal answer’ by drawing on Duncan Kennedy’s suggestion that a claim to the rightness of one’s legal propositions is a central characteristic of the legal profession. We first ask how changes in the organisation of legal services affect the ability of lawyers at law firms to produce that ‘right legal answer’. While legal tech only exacerbates already ongoing processes of eradication of routine tasks, we find that it continues to mask the role of ideology in arriving at a right legal answer under a new layer of technological projection. Second, we ask how lawyers’ ability to produce ‘the right legal answer’ is affected by, first, expert systems and, second, a legal tech application named Bryter, representing a no-code system. We find that expert systems do not permit to uphold the unity of the lawyer required for Kennedy’s model of the right legal answer, but that no-code systems as Bryter do so. No-code systems can be reduced to a slogan: Have the lawyer, but evict her ideological temptations more efficiently than before!© 2023, The Author(s).

    • The Swedish chapter of this Handbook aims to summarize and critically analyze relevant law and practice in Sweden as of early 2024 concerning social parenthood, a topic being investigated in light of EU-level efforts to harmonize or otherwise minimize discrimination against certain EU citizens, be they parents or children, due to the social instead of traditional biological basis of their parent-child relationship.It analyzes the Swedish legal concepts of parenthood, family, social parenthood and de facto parenthood, how parenthood is established (by automatic operation of Swedish law, by consent or intention such as in situations of confirmation of parentage, adoption, and medically-assisted reproduction) as well as ways that current law and its application, including in cross-border cases such as those in which recognition of foreign-issued parenthood-related documents is sought, can lead to discrimination and its negative consequences for children and parents.    As the Handbook's Policy Recommendations explain,"Social parenthood is an umbrella term used to describe the relationship between a person assuming parental status or parental responsibility anda child, in the absence of a genetic, biological, and gestational contribution between the former and the latter. The category includes all forms offiliation resulting from the various types of adoption, including stepchildadoption, as well as filiation resulting from donor-gamete-based medically-assisted reproduction, medically-assisted procreation (MAP) using acouple’s own gametes, surrogacy, post-mortem procreation (use of gametes after a natural parent’s death), adoption of embryos, and heterologousMAP by mistake (switched gametes at the lab resulting in a child not biologically related to the intended parents)."Social parenthood further includes functional/de facto parenthoodby adults in actual parenting roles with a child and parenthood foundedon informed consent more generally. In the free-movement context, itincludes cases in which certain countries provide legal status to a parentchild relationship while in other states the parent and child are treated as“legal strangers”."By including the concept of social parenthood in legal regulation of thefamily, such legal harms can be avoided and more emphasis can be placedon what is central for the child: enduring care for the development of theidentity of the child, in coordination with the document “EU strategyon the rights of the child”.     • The problem of excessive debt among households in Sweden is increasing. As a result of the development within the financial sector, households in Sweden have increased their debt incurrence markedly. It has been relatively easy to borrow money, due to the deregulation of the credit market in Sweden in the 1990s and the low interest rates in recent years. As mortgage loan is the bulk of the total household debt, the risk that individuals will be affected by excessive debt incurrence and insolvency has therefore increased. Therefore, a number of new legislative changes have been implemented to overcome this problem. In order to prevent these risks, the Financial Authority has adopted a rule that stipulates that new loans should not exceed 85% of the property market value. Reports from both the Swedish Enforcement Authority and the Swedish Financial Supervisory Authority show that 20% of Swedish households have a difficult time making ends meet. Those who are affected by excessive debt often experience a lower standard of living since frequently they are impacted by distraint.The aim of this paper is to describe and analyze the excessive debt situation in terms of insolvency and effects on households and society. Firstly, we intend to investigate foreclosures in Sweden, both regionally and over time. Why are certain regions less frequently affected by these risks while other regions show higher levels of risk even during generally good years? Secondly, we will investigate whether (a) whether properties that have undergone executive auction are sold at a lesser value, (b) if these properties have an impact on the property prices in the vicinity and (c) if those who buy these properties themselves run a greater risk of insolvency. Thirdly, a closely related area of legal interest is investigating to what extent legislation provides a protective net for the debtor who, through the executive auction, thereby loses his/her residence.

    • I detta samtal bjuder vi in till ett utbyte av erfarenheter och tankar om hur vi som pedagoger kan arbeta med kunskap som på ett mer grundläggande plan är utmanande för studenterna. Med utmanande menar vi i detta sammanhang inte att kunskapen är tekniskt svår eller komplex utan att den ger studenten skäl att ifrågasätta tidigare positioner. Ett ifrågasättande som direkt eller i förlängningen berör inte bara det ämne som är fokus för undervisningen utan studentens självbild, samhällssyn, ideologi mm. Vi talar om en typ av transformativ kunskap som på något plan är irreversibel (den enskilde studenten kan inte gå tillbaka till en position som förelåg kunskapandet) och vilken inte sällan kan ge upphov till ilska, irritation, och frustration hos studenter. Snarare än att få en ’lösning’ når studenten ett tillstånd av kunskapande som genererar nya frågor. Temat knyter an till det som Perkins benämnt ”troublesome learning” (Perkins 1999). Vi (Stendahl och Arvidsson) har båda från olika håll och med olika pedagogiska verktyg medvetet arbetet med besvärligt kunskapande i högskolepedagogiska situationer. Stendahl i sitt arbete med tröskelbegrepp (Meyer, Land 2003, 2005; Stendahl, Swedrup, Åberg 2021) och Arvidsson i sitt pedagogiska arbete i akademisk handledning med ’den analytiska situationen’ utifrån psykoanalytisk teori och praktik (Owler 1999, Arvidsson 2023).     • Why are democracies unresponsive to well-documented injuries in the production and by the consumption of pornography? Legal challenges to pornography in Canada and the United States in which sexual subordination, not moral notions of "obscenity," were the driving rationale, show democracies inadequately recognizing gender-specific harms. Changes in Canadian obscenity doctrines to account for harm and inequality, in contrast with the U.S. reign of "free speech," did not deliver a corresponding change on the ground. Developments in democratic theory, international law, and the particular U.S.–Canadian legal trajectory, and consideration of the void of institutions articulating the interests of those victimized in and by pornography, suggest the need to adopt empowering civil remedies.

    • ‘Insight’ is a requirement frequently evoked in the legal sources, including administrative court rulings dealing with the protective custody of children. Yet, it is neither mentioned in the applicable legislation (LVU), nor thus far addressed in the legal scholarship. The present article accordingly explores the notion as it is addressed, not only in preparatory works and jurisprudence, but also by interviewed legal practitioners and social workers dealing with social interventions for families. The empirical study shows that, in compulsory care, parents' lack of insight regarding their own situation, their children's needs or in terms of acknowledging past incidents, has in effect developed into a hard-core requirement capable of justifying coercive care. It is accordingly referred to as an uncodified legal requisite, and perhaps one of the more important ones, in fact; practitioners perceived insight to be pivotal in most legal decision-making on both the initiation and continuation/termination of care. But insight into what? And how is a person’s insight measured? How much insight is enough? The subject of parents’ insight, as well as its evaluation, is found to be both practically opaque and legally problematic. Procedural ambiguities, institutional entrenchment, and professional projections paint a complex image, best described as a minefield for all agents and parties involved.
