    • Legal security in public administration is one of the prerequisites for a legal state. It can be promoted through supervision by public authorities. The need of supervision has increased due to the development of public administration. EU law has also had a clear impact on the development of supervision and its regulation. Supervision can be of special value where formal decisions are rare and the individual has limited access to courts in order to gain access to justice.The study examines how legal security in supervision relating to the rights of the individual has developed since the middle of the 20th century in five different areas: social services, health care, discrimination legislation, data protection and the general supervision of public administration carried out by the Parliamentary Ombudsman. The study also examines the purpose and function of supervision as a constitutional control tool in relation to the rights of the individual.Effective supervision from a rule of law perspective should combine monitoring on a systematic level with investigation of individual complaints and well-functioning levels of supervision. The investigation of individual complaints can build trust and legitimacy and help supervisory authorities to detect relevant misconduct. Active participation by individuals can contribute to the implementation of supervision as a constitutional control tool, which may favour the individual, indivuals collectively and the legal state.

    • This doctoral thesis investigates and analyses the Swedish employers’ legal responsibility for the work environment and rehabilitation efforts. The focus of analysis is on the legal requirements to be met by the employer and the legal mechanisms available to enforce the requirements. The measures the employer must take regarding the work environment and rehabilitation are regulated by different types of rules that impose some clear and some less clear requirements. Some rules are statutory, and some instead have been imposed by governmental regulations. In order to define the responsibilities of the employer, this study categorizes all of these requirements according to their design: they may constitute specification standards, performance standards, process-based standards, or general duties. To define the employers’ legal responsibility, the conditions that must be fulfilled for the legal enforcement of the requirements also need to be clarified. Enforcement is accomplished through, among other mechanisms, injunctions, fines, criminal sanctions and employment protection rules.The study describes and demonstrates the links between, on the one hand, the design of the requirements and, on the other hand, the legal possibilities for enforcement. It also shows that an employer’s overall legal responsibility for the working environment and rehabilitation is complex. There are differences in the design and functioning of the employer’s proactive responsibility – the responsibility to prevent ill health and to pro­mote health – and the reactive responsibility – responsibility for rehabilitation. There are also major differences in the regulation of different aspects of work environments, with rules varying based on types of work done and risks faced, and based on how the organizational rehabilitation responsibility is designed compared to the responsibility for the individual worker’s rehabilitation. The study also clarifies how the legal regulation of the employer’s responsibility for the work environment and for rehabilitation can contribute to the overall policy objective of ensuring for every worker a sustainable working life.

    • In Sweden, unlike for example Norway, problems associated with people "falling between the cracks" and ending up outside the welfare systems has not led to extensive restructuring of the social insurance system. Instead, in many cases, cooperation between authorities and responsible actors is emphasized as a means to prevent social and economic exclusion. Since 2008, cutbacks in Swedish sickness benefits has increased the proportion of job seekers with weak ties to the labour market, thus also increasing the number of individuals potentially subject to such cooperation. However, our study shows that those denied of sickness benefits, as the Social Security Agency considered them capable of working, will not in all cases be eligible for unemployment benefits. One reason is that different work ability concepts apply, where the assessment of the right to sickness benefits is characterized by the purpose to insure those unable to work due to sickness, whilst the corresponding assessment in the unemployment insurance is characterized by the purpose to insure those who are able to work. It also shows that a clear assessment of the overlap between these respective work ability concepts is made difficult, especially due to unclarities regarding what constitutes work ability in the unemployment insurance. Therefore, the design of the insurance systems affects the potential to reduce exclusion through cooperation, and poses challenges to legal security for those in transition between the systems and to a well-informed management of insurance policies.
