    • From a labour law perspective different institutional arrangements for monitoring employment conditions are analysed primarily as means of effective protection of rights. From the perspective of market integration and particularly the free mobement of services, on the other hand, national monitoring measures are analysed primarily as restrictions of economic freedoms. The aim of this chapter is to analyse how these different perspectives on arrangements for monitoring labour standards for posted workers are reflected in the position taken by the EU institutions and the Member States.

    • Using longitudinal data on labour law in France, Germany, Japan, Sweden, the United Kingdom and the United States over the period 1970-2010, the authors estimate the impact of labour regulation on unemployment and the labour share of national income. Their dynamic panel data analysis distinguishes between the short-run and long-run effects of regulatory change. They find that worker-protective labour laws in general have no consistent relationship to unemployment but are positively correlated with labour's share of national income. Laws specifically relating to working time and employee representation are found to have beneficial effects on both efficiency and distribution thus proxied.

    • In March 2012, the Commission presented two legislative proposals – the Monti II-Regulation and the Enforcement Directive. The proposals constitute a response to the intense debate following the CJEU’s rulings in the Laval quartet. The first proposal, the Monti II-Regulation, aims at clarifying the relationship between the right to take collective action and the economic freedoms. Its vague formulation, however, puts its potential to change the state of law in question. The second proposal, the Enforcement Directive, aims at improving the enforcement of the Posting of Workers Directive. In doing so it shall equally ensure workers’ rights and enhance cross-border services by reducing employers’ administrative burdens. It is doubted, however, whether the methods chosen will be effective, especially that the Directive seems to overlook how closely the different enforcement mechanisms are linked to individual institutional arrangements in the Member States. The following paper analyses these two proposals, examines their potential implications and suggests alternative approaches.
