- Security of tenure legislation covers three areas: protection against unjust eviction, unreasonable increases in rents, and mismanagement of properties by landlords. There are large differences between countries concerning how far the tenant can get legal protection or if all protection must be in the form of clauses in the contract. The theoretical argument for some kind of tenant protection is the existence of high transaction costs that weaken the bargaining power of a sitting tenant. Side effects include higher initial rents and stricter screening by landlords when letting to a new tenant. However, a certain level of tenant protection might be necessary to make the rental market attractive to housing consumers.
