  • EU Procedural Criminal Law After Lisbon
  • 2019
  • In: The Future of EU Criminal Justice Policy and Practice : Legal and Criminological Perspecives - Legal and Criminological Perspecives. - : Brill Academic Publishers. - 2589-4447. - 9789004367371 ; 1, s. 225-254
  • Book chapter (peer-reviewed)abstract
    • This chapter addresses the EU’s policy in the field of procedural criminal law. It sketches how issues similar to those discussed in the field of substantive EU criminal law can arise in the field of procedural law and argues that they should also be studied from within multiple disciplines. It tentatively proposes that a more evidence- based understanding of the exercise of competences in this field is a feasible model to restrain illegitimate ‘competence creep’ from the EU legislator.

  • Collaboration between the Danish and Swedish hernia registers – a study protocol
  • 2022
  • In: Danish Medical Journal. - : Almindelige Danske Laegeforening. - 2245-1919. ; 69:12
  • Journal article (peer-reviewed)abstract
    • NTRODUCTION: The most common laparo-endoscopic groin hernia repair techniques are TEP (total extraperitoneal) and TAPP (transabdominal preperitoneal) repair. Despite geographic proximity, Swedish surgeons distinctively favour TEP, whereas Danish surgeons prefer TAPP. The aim of this study is to analyse the risk of reoperation for recurrence after TAPP, TEP and Lichtenstein repair using data from two nationwide registers. We also aim to discuss advantages of international collaboration between nationwide registers.METHODS: All groin hernia operations registered as TEP, TAPP or Lichtenstein repair in the Swedish Hernia Register and the Danish Hernia Database between January 2004 and December 2020 will be included. Cumulative hazard rate of reoperation for recurrence will be estimated using Cox-regression analyses adjusted for age and anatomy.CONCLUSION: Approximately 400,000 operations are estimated to have been registered prospectively in the inclusion period in the registers. The merging of two nationwide registers was made possible owing to close cooperation between the register steering committees and by obtaining the necessary approvals. This unique collaboration between nationwide registers will make it possible to compare the risk of reoperation for recurrence after TAPP, TEP and Lichtenstein repair on an international level. In future, similar collaboration may be established to explore other outcomes such as complication rates and chronic pain.

  • The journey of EU criminal law on the ship of fools – what are the implications for supranational governance of EU criminal justice agencies?
  • 2021
  • In: Maastricht Journal of European and Comparative Law. - : Sage Publications. - 1023-263X. ; 28:2, s. 192-211
  • Journal article (peer-reviewed)abstract
    • This article addresses supranational governance of EU criminal justice agencies from the perspective of the various agencies of policy and rulemaking who have contributed to the impressive developments in the field of EU criminal law. Taking as a working hypothesis the happenstance and haphazard character of this field of policy and law, it suggests that there is an absence of design. In the discussion the article proposes the Platonic analogy of the ‘ship of fools’ (Plato, Republic, Book VI) as an explanatory tool. The ship's captain is the guiding spirit of criminal law, but the crew of the ship, who have the power to take control, have diverse interests and ideas about how the ship should be taken to sea and navigated. The article addresses thematically and chronologically the development of EU criminal policy by means of this framework. Subsequently it discusses the extent to which the ‘ship of fools’ analogy is relevant to the development of EU criminal justice agencies, and to the emergence of a European Public Prosecutor. Underlying all this discussion is the uneasy sense that the true pilot of EU criminal law and policy has been displaced, in particular by ‘instrumental’ pilots of securitisation and effectiveness.

  • The Future of EU Criminal Justice Policy and Practice : Legal and Criminological Perspectives
  • 2019
  • Editorial collection (peer-reviewed)abstract
    • EU criminal justice is a fast developing and challenging area of EU law and policy that requires scholars from different disciplines to join forces. This book is a first attempt to establish such synergies. Coming from different angles, the authors deal with questions in the area of EU substantive criminal law, such as when criminalisation of conduct is an appropriate choice; how the process of (de)criminalisation could be advanced; what the role of evidence could be in this regard; and what consequences criminalisation decisions at EU level have for national legal orders. The book concludes with a demonstration of how similar issues arise in the field of procedural criminal law.
