    • In this article, we aim to explore the contours of how we might interrogate Swedish labour lawand practice from a socially oriented sustainability perspective, drawing on the distinctive findings of ourproject ‘An inclusive and sustainable Swedish labour law – the ways ahead’ and on other aspects of theSwedish labour law model that we consider are particularly relevant for a sustainability analysis. In sodoing, we have identified potentially five dimensions to the use of a ‘sustainability’ discourse as a basis forevaluation of regulatory measures suitable for the Swedish labour market. It emerges that the central dominant system of collective bargaining has the potential to promote durability and inter- and intra-generational justice, including just transitions in the labour market. However, its capacity to promote capabilities and equality depends on how inclusive and adaptable collective bargaining systems are, with attentionto who is being represented and in what sectors.

    • Fokus i detta kapitel ligger på den svenska ILO-kommitténs verksamhet från 1977 till våra dagar (avsnitt 4). 1977 var ett avgörande år för ILO-kommittén. Genom ratifikationen av ILO:s konvention nr 144 om samråd på trepartsbasis för att främja genomförandet av ILO:s normer (1976) ändrades förutsättningarna för  ILO-kommitténs verksamhet och kommittén fick en ny instruktion som arbetet ännu idag utgår ifrån. Det huvudsakliga syftet med kapitlet är att belysa ILO-kommitténs roll över tid och fånga in vissa utvecklingslinjer. Strukturen i avsnittet utgår från de uppgifter ILO-kommittén har enligt sin instruktion. Avsnitt 2 går dock längre tillbaka i tiden för att beskriva kommitténs tillkomsthistoria. I avsnitt 3 avhandlas bakgrund och framväxt av ILO:s konvention nr 144. I avsnitt 5 lyfts EU-medlemskapets inverkan på ILO-kommitténs arbete och i avsnitt 6 görs en jämförelse med övriga nordiska länders motsvarande organ. Avslutningsvis ges i avsnitt 7 några sammanfattande reflektioner.

    • The Seasonal Workers Directive combines immigration law, which regulates entry and stay in a territory, with labour law, which governs the rights of workers. The different interests and expertise of the various EU institutions involved in the Directive’s drafting and adoption exacerbated the tension between these two legal fields. In turn, this tension compromised the achievement of several of the EU’s explicit objectives, namely, creating a level playing field for the recruitment of seasonal migrant workers across the Member States, instituting a circular migration program, and protecting migrant workers from economic and social exploitation. This article focuses on the extent to which the Directive has the capacity to protect seasonal migrant workers. To do so, it sketches the history of the Directive and discusses some consequences of its treaty basis, which provides the context for our analysis and evaluation of the substantive provisions of the Directive.

    • This article seeks to probe the controversial relationship between seeking asylum and the permission (or obligation) to work. In doing so, we recognise the concurrent claims that can be made for asylum and access to the labour market, problematising the concept of ‘work’ and its relationship to freedom and dignity from the perspective of international refugee law and European human rights norms alongside European Union (EU) law. We examine how British and Swedish legal systems have reflected two starkly opposed policy stances. The UK has long denied asylum seekers the financial and psychological benefits that come with work usually until refugee status is formally granted, but the Swedish system has facilitated a complementary pathway for asylum seekers whose labour can make (what is determined politically to be) a sufficient contribution to the economy. We identify the perceived benefits and failings of each strategy. In this context, we observe that the status quo in both countries is changing and even arguably converging around an illiberal consensus regarding the relationship between asylum and work, which will demand further attention and potentially legal challenges in the years to come.
