- Legal security in public administration is one of the prerequisites for a legal state. It can be promoted through supervision by public authorities. The need of supervision has increased due to the development of public administration. EU law has also had a clear impact on the development of supervision and its regulation. Supervision can be of special value where formal decisions are rare and the individual has limited access to courts in order to gain access to justice.The study examines how legal security in supervision relating to the rights of the individual has developed since the middle of the 20th century in five different areas: social services, health care, discrimination legislation, data protection and the general supervision of public administration carried out by the Parliamentary Ombudsman. The study also examines the purpose and function of supervision as a constitutional control tool in relation to the rights of the individual.Effective supervision from a rule of law perspective should combine monitoring on a systematic level with investigation of individual complaints and well-functioning levels of supervision. The investigation of individual complaints can build trust and legitimacy and help supervisory authorities to detect relevant misconduct. Active participation by individuals can contribute to the implementation of supervision as a constitutional control tool, which may favour the individual, indivuals collectively and the legal state.

- The aim of this dissertation is to map and examine the regulation and the division of responsibilities in the quality assurance system in Swedish health care. The system includes actors of various kinds, all with different responsibilities aimed at ensuring that patients are provided with health care of good quality. The actors who are examined are both the internal actors such as health care providers and health care personnel, and the external actors, consisting principally of the National Board of Health and Welfare (Socialstyrelsen), the Medical Responsibility Board (Hälso- och sjukvårdens ansvarsnämnd) and the local Patient Committees (patientnämnder).The point of departure is the goals and demands stipulated in the Health and Medical Services Act (1982:763). Furthermore, section 31 in this Act explicitly stipulates that the quality of health care shall be guaranteed and systematically and continuously developed. Chapter Three in the new Patient Safety Act (2010:659) also imposes a duty on health care providers to systematically work to ensure a high level of patient safety.Other necessary conditions are the health care personnel’s education, demand on authorization and the obligations and duties stipulated by law. The National Board och Health and Welfare has an important role in the system, controlling that the health care providers as well as the personnel fulfill their obligations and duties.One of the main conclusions is that the set of regulations concerning health care and quality assurance needs to be revised in order to become clearer, more logical, more applicable and more accessible. Another conclusion is that the actors who supervise the internal actors must make sure that the legal tools available are used when needed. In short, the control system must also work effectively.

- Lotta Vahlne Westerhäll är professor i offentlig rätt med särskild inriktning på socialrätt och har i sin forskning sysslat mycket med socialförsäkringsfrågor. Hon är författare till rättsanalyserna om graviditetspenning- och föräldrapenningförmåner i Lexino. Hennes ambition är att rättsanalyserna ska vara så pass kompletta att de klargör det aktuella rättsläget och vara skrivna så att de tillgodoser behovet hos en specialist på området. Lexino fokuserar på att från ett objektivt perspektiv klargöra det aktuella rättsläget och de typiska tillämpningsfrågor som aktualiseras i anslutning till gällande lagstiftning. I den djupa kommentaren hänvisas till andra rättskällor såsom lagstiftning, förarbeten, praxis och doktrin. Lexino klargör på ett objektivt sätt det aktuella rättsläget och är så pass fullständig att den praktiskt verksamme juristen klarar sig med Lexino som enda källa tillsammans med Karnov.
