    • As with many biodiversity laws, the Habitats Directive allows for exemptions. While it can be argued that flexibility is necessary for handling dynamic ecosystems, the associated lack of legal clarity on the room to derogate can risk impairing both the effectiveness and the uniform application of EU-law. This study aims at clarifying the conditions to derogate from the strict protection of species under Article 16(1)(e), a provision which has been interpreted to provide a legal basis for hunting species with a favourable conservation status in several Member States. One such controversial case is the hunting of brown bears in Sweden. The Swedish brown bear management will thus be used as an illustrative example to discuss Member States’ discretion to derogate under Article 16(1)(e).

    • This study aims at discussing whether or not hunting to manage strictly protected species with favourable conservation status is in compliance with the directive by assessing the nature and content of the obligation to protect Annex IVspecies. The conditions determining Member States’ room for derogations under Article 16(1)(e) will be scrutinized and arguments for and against certain interpretations will be provided. Based on the assessment the compliance of the administrative practices of quota hunting on bears in Sweden will be addressed.Although the study discusses the management of bears in Sweden, the assessment of EU-law and in particular Article 16(1)(e) of the Habitats Directive, is of relevance for any Member State with large carnivores listed in Annex IV with favourable conservation status within their territory.

    • Fishing operations likely to have a significant effect on a marine Natura 2000 area shall be subject to prior assessment and authorisation according to Article 6.3 of the Habitats Directive. This provision, partly also article 6.2, and in particular the CJEU case law, implies that this prior control should be applied rather often in practice, even for recurrent fishery irrespective of when the first fishing operation occurred in an area. Article 11 of the Common Fisheries Policy Regulation entails that Sweden and other Member States apply Article 6 of the Habitats Directive within the entire exclusive economic zone, to both own and foreign fishing vessels. A Member State is also, under certain preconditions, empowered to impose restrictions on fishery not supported by article 6 of the Habitats Directive, especially within the 12 nautical miles zone. A Member State is not formally hindered from excluding fishery from prior assessment and authorisation if instead general requirements on fishery in legislation can ensure that no future fishing operation is likely to have a significant effect on the Natura 2000 area. However, CJEU case law indicates that it would be difficult to fulfil that precondition. © 2015 Koninklijke Brill NV, Leiden.

    • In the European Union (EU), the Habitats Directive bans the killing of strictly protected animal species. The killing of individual animals may nevertheless be allowed when there is no satisfactory alternative and doing so would not be detrimental to the maintenance of species populations at favorable conservation status for one of five enumerated reasons. This exception has been used by national authorities to allow hunting, frequently triggering litigation. Here, we review several contested aspects of the provisions allowing exceptions from strict protection, particularly those in the controversial Article 16(1)(e), in order to clarify Member States' discretion in allowing hunting. Correctly interpreting these provisions is necessary to ensure species are protected at the level intended by the Habitats Directive, and that their conservation status is improved or maintained. Our review suggests that it would be very difficult for national authorities to allow the hunting of strictly protected species while complying with EU law.

    • Forskargruppen ska genom analyser och synteser identifiera styrkor och brister i de utvärderingar som görs av styrmedel i fiskeri- och havsmiljöförvaltningen, samt utifrån detta föreslå åtgärder som skulle kunna förbättra framtida utvärderingar. Arbetet kommer att resultera i övergripande syntes av hur olika typer av samhällsekonomiska analyser kan användas för att utvärdera styrmedel inom området (med hänvisning till tidigare utvärderingar), samt en fördjupad analys av tidigare utvärderingar av styrmedlet överförbara kvoter inom det pelagiska området.

  • The economics of the Swedish individual transferable quota system: Experiences and policy implications

    • Sweden and other European Union countries are currently carrying out extensive work aimed at improving the marine and freshwater environment. The adaptive management approaches typically used for this require the development of new policy instruments and measures when needed, but also evaluations of instruments and measures already in use or under way. This paper reports on a study of the Swedish individual transferable quota system introduced in 2009 for the pelagic fishery. The new system was motivated mainly by economic arguments and, thus, the need to get incentives right. Despite this, the design of the Swedish system weakened the intended incentive effects in several ways, compared with the foreign systems that served as models. Moreover, the information needed for future evaluations was not collected, even though the need for future evaluations had been expressed explicitly and the data needs for this could be identified at the time that the system was introduced.
