Vem äger naturen? : En fastighetsrättslig studie om förhållandet mellan äganderättens brukandedel och skyddet för naturvärden

• Vem äger naturen? handlar om hur egendomsskyddet hanteras inom ramen för skyddet för naturen inom olika utvalda naturskyddande bestämmelser. Bland annat naturreservat, skogligt naturskydd, artskydd och strandskydd analyseras utifrån egendomsskyddets olika delar som hur det angelägna allmänna intresset manifesteras, hur proportionalitetbedömningen sker och hur det resoneras i frågan om ersättning.Genom att granska hur äganderätten kan begränsas vid skyddet för naturen framkommer något om hur ägarens rätt att bruka, brukanderätten, ser ut i rättsordningen. Boken syftar därmed till att bidra till en utredning om en del av äganderätten och hur den faktiskt ser ut i rättsordningen. I den delen innehåller boken även ett fylligt historiskt avsnitt om synen på äganderätten genom tiderna, hur bruket av skogen begränsats och om regelrätterna.Boken föreslår i analysavsnittet en mer gemensam modell där alla olika ingrepp i äganderättens brukandedel kan ske på ett mer likriktat sätt än idag. Det gäller att få en mer samlad bevisprövning, proportionalitetsbedömning och ersättningsbestämning. En sådan modell bör kunna användas på alla typer av ingrepp i brukanderätten, oavsett vilken grund dessa har.

• Who owns nature? is about how the protection of property rights is handled within the framework of the protection of nature within various selected nature protection regulations. Among other things, nature reserves, forest nature protection, species protection and beach protection are analysed based on the different parts of the property protection, such as how the urgent public interest is manifested, how the proportionality assessment its executed and how its reasoned in the question of compensation.By examining how ownership can be limited in the protection of nature, something can emerge about how the owner's right to use, the usufructuary part of ownership, looks like in the legal system. The book thus aims to contribute to an investigation into a part of property rights and how it actually looks in the legal system. In that part, the book also contains a fairly comprehensive historical section on the view of property rights through the ages, how the use of the forest has been regulated and on regal rights.In the analysis section, the book proposes a more common model where all different interventions in the use part of ownership can take place in a more equivalent way than today. This is executed via a more unified examination of evidence, proportionality assessment and determination of compensation. Such a model should be able to be used for all types of interventions in the right of use, regardless of the basis for these.
