Djurskydd som rättsligt intresse och djurplågeribrottet i Sverige

• I Sverige kan djurplågeri straffas enligt 16 kap. 13 § brottsbalken (1962:700). Eftersom detta straffstadgande kriminaliserar att ”otillbörligen” utsätta djur för lidande, innefattar djurplågeribrottet vanligen en underförstådd intresseavvägning mellan ett djurs lidande och de av människor betingade orsakerna till lidandet. Syftet med denna artikel är att studera de tillämpningssvårigheter som uppstår till följd av denna underförstådda avvägning. Rättsdogmatiska, rättshistoriska och idéhistoriska teoriperspektiv används. Slutsatsen av undersökningen är att djurs lidande och förklaringarna till människors beteenden kan ses som inkommensurabla intressefaktorer, och att viktningen mellan dessa därför tenderar att styras av beslutsfattarnas personliga värderingar.

• In Sweden cruelty to animals can be penalized according to chapter 16, section 13 of the Penal Code (1962:700). Since the law demands the cause of the cruelty to be improperly, the crime often includes a weighting between the suffering of animals and the grounds of human behaviour that caused the suffering. The aim of this article is to study difficulties in the weighting between these factors. Methods of legal dogmatism, legal history and history of ideas are used. The article finds that suffering of animals and grounds of human behaviour often can be seen incommensurable factors, and that weighting between these factors therefore depends on the values of the person making the decision.
