Protecting Children Against Detrimental Family Environments under the 1996 Hague Convention and the Brussels II bis Regulation

• With the Boll-case as the starting point, decided by the International Court of Justice in 1958, the contribution analyzes subsequent legal cooperation across frontiers to protect children against detrimental family environments. Special attention is given to Dutch and Swedish case law, the 1996 Hague Convention, the EU's Brussels II bis Regulation and the case law of the EU Court. The authors conclude that European children, indeed, are somewhat "better off" with the two new international instruments, inspite of the difficulties experienced on a national level regarding how to interpret and apply these instruments.
