- An increasing number of litigations before the International Court of Justice (ICJ) concerns situations involving serious crimes (genocide, crimes against humanity and war crimes). However, to date, several of these litigations have failed to deliver justice in the form of reparations to the victims of these crimes. Two recurrent legal obstacles impede effective results: the limits imposed on this court’s jurisdiction as well as the strict rules of evidence imposed by the court itself. Following an in-depth consideration of these obstacles, the chapter discusses the question whether and, if so, why the judicial avenue offered by the ICJ can still be seen as useful from the perspective of strategic human rights litigation.
